Please note that these are the terms for our POWER HOSTING plans only. MS and Linux hosting terms are found within their respective pages.
1.) Compila Ltd take no responsibility
for any information loaded to our customers accounts
or web sites. If it is brought to our attention,
and we deem the material to be inappropriate,
we will suspend the customer's service on accounts
or web sites, until any illegal or inappropriate
data is removed.
2.) The customer will fully indemnify Compila Ltd
against liability (of any nature), which may befall
Compila Ltd as a result of the customers illegal
use of our services.
3.) Refunds are only available, if the level of service
provided to the customer by Compila Ltd, is determined
unsatisfactory by the staff of Compila Ltd. No
refunds are available if the customer wishes to
cancel their account for any other reason. An
administration fee of £2.00 + Vat may become
due to cover bank and credit card charges.
4.) Customers shall not provide copyrighted materials
without authorisation, provide obscene or offensive
material (e.g. pornographic), provide material
whose nature and/or volume compromises the ability
of Compila LTD's servers to serve other customers'
web sites (instances including but not limited
to unreasonable consumption of disk space, Internet
link bandwidth, CPU, and memory usage, as determined
by Compila LTD's staff), provide materials that
are deemed by the government authorities as inappropriate
or illegal. Any such government determinations
will be binding on the customer, not Compila Ltd.
5.) Compila Ltd may not wish to host web sites, including
but not limited to the following content, adult,
games, mobile phone tones or logos, computer games,
celebrities, warez, web sites owned by any customer
under 18 years of age, sites with webcams.
images, video, and other content accessible via the World Wide Web. A Storage Service Provider (SSP) is a company that provides computer storage space and related management services. SSPs offer also periodic backup and archiving.
Compila.com offers only web hosting services, not data storage services. A web hosting service consists of the following:
6.)Service Features
- Disk Space - We use a clustered storage technology. This means that the storage resources of a hosting plan purchased from us are not confined to a single server, but are distributed between multiple machines. This way optimal performance is guaranteed and higher server stability. It also ensures that you will be able to avail of all the storage quota that has been assigned to your particular account. Additional disk space is available as an upgrade option. Payment is accepted only in advance per year. Contact sales for more information.
- Traffic - Each hosting plan includes prepaid monthly traffic in Megabytes. This traffic quota is shared between all sites hosted in a single account. In case that a hosting account exceeds its allowed traffic quota, it will be suspended until the beginning of next month when the quota will refresh automatically. Additional traffic is available as upgrade. Contact sales for more information.
- Hosted Domains - Compila.com's hosting plans include domain hosting. Each hosting plan allows a particular number of domains that can be hosted.
- E-mail accounts - different number of e-mail accounts are available for setup with each web hosting plan.
- MySQL/PostgreSQL Database(s) - MySQL databases are included in all web hosting plans. Additional databases are available as upgrade. PostgreSQL databases can be either included or optional. Contact sales for more information.
- Database Storage - Each hosting account has a limit of database storage. This storage is shared between all the databases in a single hosting account. Additional database storage is available. Contact sales for pricing.
- IP Address - Compila.com hosting accounts do not include IP addresses. For many customers IP address is important for starting SSL hosts, that's why we allow the purchasing of IP addresses. Payment is accepted only in advance per year. Contact sales for more information.
- SSH - In case your hosting account does not include SSH, please contact sales department for more information on how to obtain it. Payment is accepted only in advance per year.

7.) Service Payment
When signing up for an account with Compila.com, the Customer agrees to pay for the period of one year (365 days) and abide by our Order Verification Policy. Our Sales Department will strictly scrutinize each account order and carefully processes each payment in order to ensure that no fraudulent user can take advantage of our web hosting system.
Compila.com will charge customers with fees based on the fee structure of our web hosting system at the time of the sign-up process. Compila.com reserves the right to introduce price changes to the packages when needed. This means that the current price list at our web store may differ from the pricing of your web hosting account.
Each customer of ours will be able to take advantage of the package he/she has purchased at the introductory price levels, and with one and the same set of features in the course of the whole contract period. Compila.com reserves the right to introduce certain changes to the packages (in the form of complementary services) to the benefit of the customers.
8.) Service Guarantees
Compila.com guarantees 99.9% network uptime and server stability. This, however, does not refer to problems stemming from:
- Server Hardware Breakdown;
- User error(s) or purposeful interruption(s) of the user service (e.g. if the client shuts his/her own server down, Compila.com is not responsible for the downtime);
- Failure due to software that is not explicitly supported by Compila.com. If a hardware crash provoked by the customer consequently occurs, Compila.com is beyond the control and responsibility for the resulting downtime.
9.) Account Data Backup
Our backup service is provided as a courtesy to you and therefore, Compila.com will be in no way held responsible for the files stored in your account. You, as a customer, agree to take full responsibility for all the files in your account and to maintain an appropriate backup of the data stored on our servers. We will back up the files located in the /www folder of your account, as well as the databases you have created.
IMPORTANT: The default available backup disk storage space for each customer is 5 GB. User accounts with content over 5 GB cannot be (partially or entirely) backed up. Additional space for backup purposes is available under our Upgrade section in the Control Panel. We provide backup services only to accounts with disk space usage below the purchased backup quota limit. For example, if the purchased data backup quota amounts to 20 GB, we will back up your files as long as your account's disk usage is below the 20 GB quota limit. As soon as it goes above 20 GB of data - the backup script will no longer back up any of your files.
10.) A fee of £3.50 + Vat will become
due to any customers who wish to keep their UK
domain names for a 2nd year, but do not wish to
renew their hosting. This is the case whether
the client wishes to remain with Compila Ltd or
not.
11.) Usernames are set automaticaly for hosting accounts. If you wish to have an alternative username, then you will need to pay an admin charge of £5 + VAT. Please note that although you can register domain names for other people under your account, if you do not require a username to contain your name, then you will need to set the account up in your clients name under their own account login.
12.) Compila offer a pop3 incoming mailservice.
For pop3 services all domains hosted with us are
required to use their ISP SMTP servers to send
email. Compila do not offer a pop3 SMTP service
and cannot be held responsible for emails that
cannot be sent via this method.
13.) COMPILA GUARANTEE:
If you are not entirely happy with our web site
hosting service with regard to any technical problems
that you are experiencing that we are unable to
solve, we will offer you a full refund, less the
cost of any domain name registration fees, within
60 days of your original order date.
14.) By purchasing a Compila service, you are aware
and agree that any refund that needs to be made
to your account, due to overpayment, payments
taken in error and 60 day money back guarantee
payments can take up to 30 days to appear in your
account once you have provided Compila with your
transaction auth code.
15.) All upgrades are automated.
It is the customers responsibility to make sure
that they have purchased the correct upgrade as
Compila will be unaware of any incorrect upgrades.
If a mistake has been made, then please contact
the sales team as they will be able to help rectify
the issue.
16.) Reseller
Invoicing: All invoices are made yearly irrespective
if you have a monthly or yearly reseller plan.
If you require a monthly invoice, then there is
a £1.50 admin charge as these are created
manually.
17.) LIMITATION OF LIABILITY:
17.1 All conditions, terms, representations
and warranties relating to the Services supplied
under this Agreement, whether imposed by statute
or operation of law or otherwise, that are not
expressly stated in these terms and conditions
including, without limitation, the implied warranty
of satisfactory quality and fitness for a particular
purpose are hereby excluded;
17.2 Nothing in these terms and
conditions shall exclude our liability for death
or personal injury resulting from our negligence;
17.3 Our total aggregate liability
to you for any claim in contract, tort, negligence
or otherwise arising out of or in connection with
the provision of the Services shall be limited
to the charges paid by you in respect of the Services
which are the subject of any such claim;
17.4 In any event no claim shall
be brought unless you have notified us of the
claim within one year of it arising;
17.5) In no event shall we be
liable to you for any loss of business, contracts,
profits or anticipated savings or for any other
indirect or consequential or economic loss whatsoever;
18.1) You are solely
responsible for ensuring the Services are renewed. WE SHALL HAVE NO LIABILITY TO YOU OR ANY
THIRD PARTY IN CONNECTION WITH THE RENEWAL OR
ANY ATTEMPT TO RENEW THE SERVICES AS DESCRIBED
HEREIN, INCLUDING, BUT NOT LIMITED TO, ANY FAILURE
OR ERRORS IN RENEWING OR ATTEMPTING TO RENEW THE
SERVICES. The foregoing limitation of
liability is in addition to any other limitations
of liability set forth in this Agreement. All
invoices are sent via email and it is your responsibility
to keep your email address up to date. Compila
cannot be held responsible for invoices being
sent to the wrong email address.
18.2) Please note that your account area is for reference only. To be entirely sure of when your domains expire, please check www.whois.com and it is down to the customer to make sure that the dates within their account correspond to the correct renewal date as shown on www.whois.com
This is because that in many areas, hosting accounts are downgraded and domains that are transfered in have different renewal dates.
18.3) Please make sure that all unwanted orders are cancelled from within your account area, otherwise you account could be suspended until that order is cancelled.
19.) Service Guarantees
